Terms & Conditions – Ticket Buyers

1. Introduction

These Terms and Conditions constitute a legally binding agreement between Amateur Box Office Ltd (ABOL) and its Customer (this being the person(s) or business using ABOL as a product or service). Using the ABOL service signifies an understanding and acceptance of these Terms & Conditions and they should be read carefully.

If the Customer does not wish to be bound by these terms and conditions in full then they may not use the ABOL service.

Definitions

“Us”, “we” or “ABOL” refer to Amateur Box Office Limited, which is a private limited company incorporated in England and Wales, Company Number: 07461450. Registered Office: 40 Devonshire Street, Keighley, West Yorkshire, BD21 2AU.

“The customer” or “you” refer to any users of the web sites operated by ABOL for the purposes of purchasing Tickets from the Event Providers.

“The site” or “sites” refer to any of the web sites operated by ABOL whether branded as such or operated on an unbranded or re-branded basis on behalf of another organisation.

“Tickets” refer to your right to attend an Event and your right to occupy a specific seat at that Event. Tickets may be in the form of physical paper tickets, email or other medium, which infers proof of purchase.

“Seller”, “Event Providers”, “Production Companies” and “Societies” refer to the groups who list their events on our web site, and are the owner or authorised distributer of the event Tickets.

Sales of tickets are operated on areas of our web site, amateurgroup.amateurboxoffice.co.uk, where the prefix amateurgroup refers to the Event Provider.

The ABOL Service

The ABOL Service is a web and PC based system, operated as “Software as a Service” (SaaS)  to enable the Buyer to complete the purchasing process of the products and/or services provided by the Event Providers.

ABOL provides its system subject these terms and conditions, and the Customer agrees to use the ABOL system only in the manner it is intended, and not use any automated methods to access ticket information. All access is always logged, and violations of this policy may lead to legal action.

 

2. Events

ABOL do not produce or otherwise bring Events to market; that remains the function of the Venues, Production Companies, Amateur Theatre Societies etc, who list their Events on our Site.

ABOL do not necessarily endorse the Events listed on our site, and the site contributions from the Event Providers do not necessarily represent the view or opinions of ABOL.

 

3. Tickets

ABOL operates the service as a sales tool for the Seller. ABOL do not purchase or sell tickets directly. ABOL provides the software system and transactional infrastructure by which Event Providers make their tickets available for purchase online by Customers. We do not set Ticket Prices or determine availability or location of seating.

The Event Provider may or may not release all available tickets for sale.

On receipt of your tickets, please check that they are for the correct performance, date and time. In the event of problems, please contact the event organiser – not ABOL. All customers must hold a ticket to be admitted into the venue, and must also abide by the rules of the Event Provider and Venue operator where applicable.

All ticket prices for events that occur in the United Kingdom are stated in Pounds Sterling. ABOL accepts several methods of payment by credit and debit card to accommodate the needs of our Customers.

Specific seats may be allocated to you at the time of booking, but the Promoter or venue operator reserves the right to change these seats to others of equal value.

Ticket purchases may be subject to a booking fee.

 

4. Refunds and Exchanges

If an Event is cancelled by the Event Provider (i.e. a cancellation due to circumstances beyond ABOL’s control), The event provider agrees to refund the purchase price of your tickets less our booking administration fee; whether that fee was originally presented as a separate item or was included within the stated face value of the ticket.

Where the customer has paid by card using our merchant services, ABOL will, as soon as notified by the Event Provider of an Event cancellation, use best endeavours to contact Customers either by phone, e-mail or in writing (using the details provided at the time of booking) advising them of the cancellation and refund process. Please email cancellations@amateurboxoffice.co.uk if you have not heard from us within 7 days.

Where the customer has paid by cash, cheque, PayPal, or the providers own merchant services, the event provider will, as soon possible contact Customers either by phone, e-mail or in writing (using the details provided at the time of booking) advising them of the cancellation and refund process. Please contact the event provider directly if you have not heard from them within 7 days.

Subject to availability the event provider may be able to exchange tickets for another performance of the same Event; but tickets must be returned for sale at least 14 days before the performance. An administration charge may apply. Contact the Event provider to check.

If you are unable to attend the performance, tickets are not normally refundable, however contact the Event Provider to confirm. Booking fees cannot be refunded. Alternatively, the event Provider may attempt to resell any tickets returned after this time on the customer’s behalf. An administration charge may apply.

Except for the conditions listed above, we will not refund any monies paid.

In the event of illness of any member of the company, or any other unavoidable cause, the Event Provider reserves the right to make changes to the advertised programme or cast without prior notice.

The advertised running times of performances may change so please check with the Event Provider on the day of the performance for confirmation.

Where we make the collection of Tickets available at the venue prior to the performance, they must be collected at least 15 minutes before the performance starts.

 

5. Discounts

If the Event Provider operates a group discount scheme, all tickets must be purchased at the same time to qualify. Proof of eligibility may be required to receive a discount.

 

6. Children

Please check the rules of the Event Provider and Venue operator. In general, children over 18 months of age must have a valid ticket and occupy their own seat. Children under the age of 14 must be supervised by a parent or guardian over the age of 18 at all times whilst at the venue.

 

7. Accessibility

Depending on the venue, wheelchair spaces may be provided subject to availability. Please contact the Event Provider box office to discuss any access requirements. For Health and Safety reasons, the Event Provider officials and helpers cannot normally assist wheelchair users to transfer into fixed seating, and it is your responsibility to provide the appropriate carers.

 

8. Website Access

You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained thereon or for any other unauthorised purpose without our prior expressed written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not access, reload or “refresh” transactional event or ticketing pages, or make any other request to transactional servers, more than once during any three second interval.

When using the Site please ensure you are using only one browser window. Using multiple browser windows could result in losing your tickets, duplicate purchases or timer expiration.

Illegal and/or unauthorised use of the Site, including, but not limited to, unauthorised ticket sales, fraudulent listings of Events by individuals or organisations other than the legitimate Event Promoter; unauthorised framing of or linking to the Site, or unauthorised use of any robot, spider or other automated devise on the Site, will be investigated and appropriate legal action will be taken, including without limitation civil, criminal and injunctive redress.

You understand and agree that in ABOL’s sole discretion, and without prior notice, ABOL may terminate your access to the Site, cancel your ticket order or exercise any other remedy available and remove any unauthorized User Content, if ABOL believes that your conduct, or the User Content you provide, violates or is inconsistent with these Terms, or violates the law or the rights of ABOL, a client of ABOL or another user of the Site. You agree that monetary damages may not provide a sufficient remedy to ABOL for violations of these Terms and you consent to injunctive or other equitable relief for such violations. ABOL is not required to provide any refund to you if you are terminated as a User because you have violated these Terms or any of ABOL’s rights.

ABOL does not promise that the site will be error-free, uninterrupted, or that it will provide specific results from use of the site or any content, search or link on it. The site and its content are delivered on an “as-is” and “as-available” basis. ABOL cannot ensure that files you download from the site will be free of viruses, contamination, or destructive features. ABOL disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose. ABOL will not be liable for any damages of any kind arising from the use of this site, including without limitation, direct, indirect, incidental, and punitive and consequential damages. ABOL makes no guarantee of any specific result from use of this site or use of the ABOL service.

ABOL disclaims any and all liability for the acts, omissions and conduct of any third party users, ABOL users, advertisers and/or sponsors on the site, in connection with the ABOL service or otherwise related to your use of the site and/or the ABOL service. ABOL is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the site.

 

9. Limitation of Liability

Neither Amateur Box Office Limited, or the Event Provider are liable for:

  • Any additional travel, accommodation, or other expenses incurred resulting from a cancelled or changed performance.
  • The loss or damage of personal property whilst at the Event.

Additionally, Amateur Box Office Limited is not liable for:

  • Content on our website contributed by the Event Provider
  • Links to, and content of the Event Provider’s own website, or other websites outside our control. By using our Site to search for or link to another site, you agree and understand that you may not make any claim against ABOL for any damages or losses, whatsoever, resulting from such action. If you have a problem with a link from the Site, please notify us by e-mailing info@amateurboxoffice.co.uk
  • Any indirect, consequential, exemplary, incidental, special or punitive damages, or for lost profits, revenues or business opportunities, even if ABOL has been advised of the possibility of such damages.

 

If the amount paid by a Customer for a ticket sold through ABOL is grossly incorrect; either due to an error in a price posted on this web site or otherwise communicated to the Customer; and regardless of whether caused by a transactional malfunction of this web site or other ABOL operated system or by human error on the part of the Event Provider; then ABOL will have the right to cancel that ticket (or the whole booking) and refund to the Customer the amount that they paid.

Whilst we endeavour to ensure that the Site is fully operational at all times, on those occasions when there are interruptions to service due to essential maintenance, system upgrades, internet service interruptions or any other factors outside our control, ABOL will not be liable for any indirect, consequential, exemplary, incidental, special or punitive damages, or for lost profits, revenues or business opportunities, even if ABOL has been advised of the possibility of such damages.

10. Privacy and Data Protection

Information supplied may be used for registered purposes under the Data Protection Act 1998. Personal data will only be used in the provision of these services. Where you have indicated that you would like to receive marketing information, your details will be made available only to the Provider of the Event you have attended. No personal information will be passed on to any other third parties without your prior agreement.

ABOL may contact you in the future to determine your satisfaction of the service, but will not advertise other events to you.
